Interim applications

Solomonic has a database of judgments relating to over 3,000 reported interim applications in the High Court over the last eight years. Click on applications by type here Applications by type to get a list of the different applications, such as summary judgment. Click on the type of application that you are interested in to see the outcomes of such applications in different courts. Application analysis - Win/Loss percentage

It tells you that around 70% of summary judgment applications succeed in whole or in part. Applications relating to jurisdictional issues have a lower success rate of only 40%.

Why not start sharing this data with clients?

Most big organisations are data led in a lot of their decision making. The historical data does not change the merits of your client’s case of course, but sharing this information helps provide context and shows you are on top of your game.

Trial outcomes

If you are interested in understanding the win/loss/settlement data relating to a specific party or barrister etc then please refer to the relevant sections above. This section focusses on understanding trial outcome data relating to specific causes of actions, which is likely to be used mainly when advising clients.

Select the “win/loss percentage” option under the Analytics > Judgments menu from the 3 lines at the top left hand of the home screen or view the Judgment analysis - Win/Loss percentage

This will take you to the following screen/bar chart:

Unless specifically stated otherwise, Solomonic on this screen provides the data from the view point of the Claimant so a failure indicates the Defendant won and a success indicates the Claimant won. Some important points to note:

  • The judgment type filter allows you to select data for either concluding or interim judgments – or both.
  • You can also narrow down your results by selecting Appeal outcomes, specific courts or judges, judgment date and subject matters.
  • If you click on a bar in the bar chart (see bar circled in red on above chart) then you will be provided with the list of cases that is visualised by the bar including a link to be able to view the case report on Bailii of any cases you are interested in.

By way of example, if you are advising a banking and finance client on a claim brought against it, relating to a breach of contract, in the KBD on the likelihood of a success at trial then by applying filters and hovering your cursor over the “all courts” bar you can ascertain that it has a 35.8% chance of successfully defending the claim:
