New Labour Code
Impact date: The new Labour Code applies from 6 November 2024 The new Labour Code, established by Law 2024-014, was enacted on 14 August 2024 and was published in the Official Journal of the Republic of Madagascar on 4 November 2024.
The previous Labour Code, Law 2003-044 contained 254 articles and was subdivided into ten titles. The new Labour Code, Law 2024-014, contains 395 articles and is subdivided into 11 titles. The major amendments of the new Labour Code are:
- Improvements and clarifications to the rules governing individual and collective labor relations in order to fill gaps from the previous Labour Code
- Alignment with the ILO Conventions ratified by Madagascar: migrant workers – domestic workers and occupational safety and health
- New provisions regarding teleworking, portage salarial and clause dédit formation
- Criminal provisions
Employer implications/action needed The provisions of the present Labour Code are automatically applicable to current individual employment contracts. They cannot constitute cause for termination of these contracts. Collective agreements that do not conflict with the new Code remain in force.
