If the Pay Transparency Directive has not yet been transposed, what steps have been taken towards implementation?
If the Pay Transparency Directive has not yet been transposed, what steps have been taken towards implementation? Consultation regarding proposed legislation for the implementation of the Directive closed on May 7, 2025. The draft proposal (including the legislative text and Explanatory Memorandum) has now been submitted to the Dutch Council of State. After the process at the Dutch Council of State has been successfully completed, the next step would be its submission to the Dutch Parliament. The Dutch government has indicated that the new legislation is intended to enter into force by 1 January 2027. The Dutch government has however further confirmed that the first reporting obligation for employers with 150 or more employees will apply to pay data for the calendar year 2027 (rather than the calendar year 2026 as per the Directive). It is unclear whether this deviation from EU rules is permitted though.
