Is there any existing legal requirement to report on any gender pay gap?
Yes.
If so, what are the requirement triggers?
All legal entities that employ workers must report to the Croatian Bureau of Statistics on the average remuneration by category of employee or position, broken down on a gender basis.
What frequency of reporting is required?
Annually.
Is the report required to be published externally?
Reports must be provided to the Croatian Bureau of Statistics, but are not made publicly available.
Is there a sanction for non-compliance with the duty to report?
Yes. Failure to provide accurate, complete and up-to-date data within the deadline specified by the Croatian Statistics Bureau can results in fines:
- Legal entities can be fined between EUR 663.61 and EUR 1327.23. A responsible person in a legal entity can be fined between EUR 265.45 and EUR 663.61.
- A single trader who is a natural person or a natural person engaged in another independent activity can be fined between EUR 265.45 and EUR 1327,23 for the same.
- A natural person can be fined between EUR 265.45 and EUR 530.89.
Has Croatia yet fully transposed the requirements of the Pay Transparency Directive? If yes, what was the implementation date and what is the name of the legislation?
No.
If the Pay Transparency Directive has not yet been transposed, what steps have been taken towards implementation?
