Current status

On 26 March 2026, Emergency Ordinance No. 18/2026 of the Romanian Government, implementing Directive (EU) 2024/825 (“The Empowering Consumers for the Green Transition Directive”) and Directive (EU) 2023/2673, entered into force, as published in the Official Gazette no. 236/26.03.2026.

Next steps

The emergency ordinance applies in phases, with certain provisions effective from 27 March 2026 and 19 June 2026, and additional key consumer protection and transparency rules becoming applicable from 27 September 2026.

Additional information

The emergency ordinance updates consumer protection rules by expanding the list of unfair commercial practices and introducing stricter requirements for environmental claims aimed at preventing misleading information. It defines key concepts such as sustainability labels, durability and reparability, and strengthens transparency obligations, including for online contracts. It also introduces a mandatory online withdrawal function, enhances consumer rights for digital content, digital services and financial services provided at a distance, and aligns national legislation with EU requirements. Enforcement is carried out by the National Authority for Consumer Protection, which may impose fines for non-compliance.
