Status

On 5 November 2025, the Council of Ministers, acting under a delegation from Parliament (European Delegation Law 2024 of 13 June 2025), approved, in a preliminary examination, a draft legislative decree that transposes the Directive.

Next steps and timing

After obtaining the other opinions required by law, the draft legislative decree will be transmitted to the Chamber of Deputies and the Senate of the Republic so that the competent parliamentary bodies may express their opinion on them and finalise the legislative approval process.

Description

The draft legislative decree updates the Consumer Code by expanding the list of banned commercial practices and sanctioning generic or misleading environmental claims when they are not reliable and verifiable. It introduces clear definitions for environmental claims, sustainability labels, durability, and reparability to ensure transparent communication and help consumers identify genuinely sustainable products. The measure also establishes new transparency rules for consumer information, including online contracts, with harmonised notices and labels on product durability. Compliance will be monitored by the Italian Competition Authority, which may impose penalties for unfair practices.
