Progress overview

Current status

The Department of Enterprise, Tourism and Employment (“DETE”) is overseeing the implementation of the ECGT in Ireland.

On 3 April 2026, a notification of the making of the European Union (Empowering Consumers for the Green Transition) Regulations 2026 (the “2026 Regulations”) appeared in Iris Oifigiúil, the official Irish state gazette, (see here).

Next steps

The 2026 Regulations will come into operation on 27 September 2026 (as stated at Regulation 1(2) of the 2026 Regulations).

Additional information

The 2026 Regulations will give effect to the ECGT in Irish law, and amend various provisions of the Consumer Rights Act 2022, and the Consumer Protection Act 2007 (the key consumer protection legislation in Ireland).

For example, Regulation 8 of the 2026 Regulations updates the list of prohibited commercial practices in the Consumer Protection Act 2007 to include ‘making a generic environmental claim, where the trader is not able to demonstrate recognised excellent environmental performance relevant to that claim’. As noted in the explanatory note to the 2026 Regulations, the amendments introduced by the new regulations ‘enhance transparency, ensure that consumers receive accurate and reliable information on environmental attributes, durability, and reparability of goods, and prohibit misleading or unsubstantiated practices, thereby supporting consumers in making informed and sustainable purchasing decisions’.
