Current Status: Implemented
Expected or actual implementation date or timeline
The KRITIS Umbrella Act (KRITIS‑Dachgesetz), which transposes the CER Directive into German national law, was published in the Federal Law Gazette on 16 March 2026 and entered into force on the following day.
If implemented, whether a transition period applies and, if so, its duration
Yes, registration will be possible as of 17 July 2026, with certain requirements to be implemented within nine and ten months after the registration.
Other important remarks/notes
Entities that are subject to the KRITIS Umbrella Act are automatically considered an essential entity under the German NIS2 implementation (BSI Act (BSIG)).
Whether a facility or installation is considered ‘critical’, and thus brings its operator within the scope of the KRITIS Umbrella Act, depends on whether the facility falls within a relevant sector and facility category and meets or exceeds the applicable threshold. As a general rule, the threshold is based on whether the facility is capable of supplying at least 500,000 persons. The specific facility categories and thresholds are to be determined in a separate ordinance (KRITIS Ordinance). A first draft of the KRITIS Ordinance was presented by the Federal Ministry of the Interior on 26 May 2026.
