Current Status: Partially implemented

Expected or actual implementation date or timeline

No confirmed adoption date. A government bill transposing the CER Directive was deposited with the French Senate on 15 October 2024, but as of July 2026 it has not yet been adopted.

If implemented, whether a transition period applies and, if so, its duration

Not applicable (directive not yet fully transposed).

Other important remarks/notes

France intends to transpose the CER Directive via a single bill covering CER and NIS2 (“projet de loi relatif à la résilience des infrastructures critiques et au renforcement de la cybersécurité”). The Bill of Law was examined and adopted by the Senate in early 2025. However, its examination in plenary session has been repeatedly postponed and it is not included on the agenda for Parliament's extraordinary session in July.

Due to the delay in transposition beyond the 17 October 2024 deadline, the European Commission has referred France to the Court of Justice of the European Union.
