Implementation status amongst the EU Member States

The Directive on Empowering Consumers for the Green Transition (ECGT) will introduce more stringent provision in relation to misleading advertising by

• prohibiting vague and ambiguous claims, and

• introduce higher thresholds to use sustainability labels, and

• banning general environmental or climate claims

The ECGT needs to be implemented in the laws of the EU Member States by 27 March 2026, and will be enforceable by 27 September 2026.

As there is no transition period included in the ECGT, per September 2026 companies need to abide by these new advertising rules when speaking about their ESG efforts.
