Companies are increasingly trading on a global scale and, despite more recent headwinds, this trend will only continue. Whilst there have been advances in the recognition of foreign insolvencies in many jurisdictions, such as the EU Directive on Insolvency Law and the UNCITRAL Model Law, there has been little, if any, global harmonization of insolvency laws. Rules vary significantly from jurisdiction to jurisdiction, and so companies need to understand those differences and how they can impact on the way they do business.

Covering a wider range of jurisdictions and updated for developments since 2020, this guide summarizes the law relating to corporate insolvency and restructuring on a country-by-country basis and answers some of the questions most likely to be asked by distressed companies or their creditors. This guide only considers the rules that apply to general company insolvency. It does not address the insolvency procedures that apply to individuals or special insolvency regimes (for example, those applicable to credit institutions, investment banks or insurers).
